Introduction

Welcome to WORK4. These Terms of Service (“Terms”) are a legal agreement between you and E-INO SHRAM DOST SOFTWARE SERVICES LLP (“Company”, “we”, “us”, or “our”) and govern your access to and use of the mobile application and related services (collectively, the “Service”). By registering for or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Refund & Cancellation Policy, and our Grievance Redressal Policy. If you do not agree, please do not use the Service.

Compliance Note: We operate in accordance with applicable Indian laws including the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023 (to the extent in force), as relevant to our Service.

1. Acceptance of Terms

By registering for or using the Service, you agree to be bound by these Terms and by all policies referenced herein. We may update these Terms at any time. Updates will be posted in the App; continued use of the Service after updates constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old and legally competent under Indian law to use the Service. By registering, you represent and warrant that you meet these requirements.

3. Account Registration

To access certain features, you must create an account and provide accurate, current, and complete information. You are responsible for safeguarding your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for lawful purposes. We reserve all rights not expressly granted herein.

5. User Content

You retain ownership of job-related content you publish (“User Content”). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, use, reproduce, display, adapt, and distribute such content in connection with providing and improving the Service. You represent that your User Content is lawful, accurate, and does not infringe any third-party rights.

Content Accuracy & Authentication

All content, including job postings, ads, and other user-generated material, is the sole responsibility of the user who creates or publishes it. While we may perform limited verification (such as Aadhaar for identity or PAN/GST for taxation purposes), we do not guarantee, endorse, or authenticate the accuracy, completeness, or truthfulness of any user-submitted content.

The Company acts as an intermediary as defined under the Information Technology Act, 2000. All content. The Company shall not be liable for any loss, harm, or damages arising from reliance on user-generated content. Users acknowledge and agree that their use of or reliance upon any User Content is solely at their own risk."

Users are advised to exercise caution and conduct their own due diligence before relying on or acting upon any content available on the platform. The Company shall not be liable for any loss, harm, or damages arising from reliance on user-generated content.

We may monitor, review, edit, or remove User Content and suspend or terminate accounts for violations of these Terms or if required by law. We may also take steps to prevent re‑occurrence of violations.

The Service may offer subscriptions for users and resellers. Subscription availability and features may change from time to time. Identity verification including Aadhaar for authentication may be required for certain subscription features. Refund and cancellation of subscription payments are governed strictly by our Refund & Cancellation Policy.

11. Ad Balance & Advertising Services

You may use Ad Balance funds to run in‑app advertising campaigns. Campaigns can be stopped at any time; any unused balance remains withdrawable subject to these Terms. We may adjust or reject ads that violate our policies or applicable law. Metrics and delivery are provided on an as‑is basis and may be affected by factors outside our control.

12. Reseller Registration

Resellers must pay a one‑time non‑refundable registration fee to access reseller services. Resellers may be required to submit valid identification (which may include Aadhaar) for verification prior to activation and during ongoing compliance checks.

13. Taxation & Compliance

For taxation and compliance purposes only, we may collect PAN (for individuals) and GST details (for corporate users). These identifiers are not used for user authentication. We may issue tax invoices and make statutory disclosures as required by applicable law.

14. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect personal data, including the use of Aadhaar (for verification/authentication only) and PAN/GST (for taxation/compliance only). By using the Service, you consent to the practices described in the Privacy Policy.

15. Intellectual Property

All content and materials on the Service—including designs, text, graphics, logos, and software—are owned by the Company or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

16. Third‑Party Links & Services

The Service may contain links to third‑party websites or integrate third‑party services (e.g., payment gateways). We are not responsible for such third parties and their content, terms, or privacy practices. Your use of third‑party services is at your own risk and subject to their terms.

External Advertisements

Our app may display advertisements or promotional content provided by third-party ad networks, affiliates, or partners. These ads are clearly marked as “Sponsored” or “Advertisement.” We do not control, endorse, or guarantee the accuracy, authenticity, or legality of such third-party ads. Clicking on an external ad may redirect you to a third-party website or app, which will be governed by its own terms and privacy policies. Users are advised to exercise caution before engaging with any external advertisements.

17. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non‑infringement. We do not warrant that the Service will be uninterrupted, secure, or error‑free. This includes, without limitation, any warranties regarding the accuracy, reliability, or quality of any job listings, user content, or advertisements displayed on the Service

18. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising from or related to your use of the Service. In no event shall the Company's total liability to you for all damages (except as required by applicable law) exceed the greater of Ninety-Nine rupees (₹99) or the amount you have paid to the Company in the last six months for the services giving rise to the claim

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, strikes or labor disputes, pandemics or epidemics, government actions or restrictions, power failures, or internet/network outages.

20. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to applicable law, the courts located at [Palakkad, Kerala], India shall have exclusive jurisdiction over any disputes arising from or relating to these Terms or the Service.

21. Grievance Redressal

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer:

Complaints will be acknowledged within 24 hours and resolved within 15 days of receipt.

22. Changes to Terms

We may revise these Terms at any time. Material changes will be made available within the App. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
